Acceptance of Terms

By accessing or using PaddlePoint, you agree to be bound by these Terms of Service, our Safety Disclaimer, and our Privacy Policy. If you do not agree to all of these terms, you must immediately stop using PaddlePoint.

Service Description

PaddlePoint provides informational weather and water conditions data for recreational paddling. The service is provided free of charge, as-is. PaddlePoint is not a professional weather service, safety advisory, or emergency notification system.

Disclaimer of Accuracy

PaddlePoint is for general informational purposes only and must not be relied upon as the sole basis for any decision to enter the water.

  • All conditions data, including the paddle score, wind, waves, tides, weather, and water quality, is sourced from third-party APIs and is provided without verification
  • Data may be inaccurate, delayed, incomplete, interpolated, or entirely unavailable at any time
  • Conditions can and do change rapidly and without warning — information displayed may already be outdated at the time you view it
  • A favorable conditions reading at any given moment provides no assurance that conditions will remain favorable
  • PaddlePoint does not account for localized hazards, water closures, marine traffic, wildlife, underwater conditions, or any other factor not captured by our data sources

You must always check official sources such as weather.gov, NOAA, local coast guard, and harbor authorities before entering the water.

Assumption of Risk

You acknowledge and agree that water activities including paddling, kayaking, stand-up paddleboarding, canoeing, and related activities are inherently dangerous and involve risk of serious injury, death, and property damage. By using PaddlePoint and choosing to participate in any water activity, you voluntarily assume all risks, whether known or unknown, associated with such activities, including risks arising from the negligence of PaddlePoint, its creators, or its data providers.

Compliance With Laws

You agree to comply with all applicable federal, state, local, and international laws, regulations, and ordinances when engaging in any water activity, including but not limited to personal flotation device requirements, watercraft registration, navigation rules, environmental protections, and local safety ordinances. You are solely responsible for understanding and following the laws and regulations that apply to your activity and location.

No Warranties

PaddlePoint is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, completeness, timeliness, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the maximum extent permitted by applicable law, PaddlePoint, its creators, operators, affiliates, licensors, and data providers shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages whatsoever, including but not limited to damages for:

  • Personal injury or death
  • Property damage or loss
  • Loss of use, data, or profits
  • Emotional distress
  • Any other damages arising out of or in connection with your use of, reliance on, or inability to use PaddlePoint

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise), even if PaddlePoint has been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless PaddlePoint, its creators, operators, affiliates, and data providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of PaddlePoint; (b) your participation in any water activity; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) any claim by a third party related to your activities.

Third-Party Data and Services

PaddlePoint relies on data from third-party services including Open-Meteo, NOAA, and Google. We have no control over the accuracy, availability, or reliability of these services. Your use of data from these providers is subject to their respective terms of service and data policies. We are not responsible for any errors, omissions, or interruptions in third-party data.

No Professional Advice

Nothing on PaddlePoint constitutes professional meteorological, maritime safety, legal, or medical advice. For professional weather forecasting, consult the National Weather Service. For maritime safety, contact the US Coast Guard or your local marine authority.

Intellectual Property

All original content, design, and code on PaddlePoint are protected by copyright. Weather data is provided by third-party APIs under their respective terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

Changes

We reserve the right to modify these Terms or discontinue the service at any time without prior notice. Continued use of PaddlePoint after changes constitutes acceptance of the revised Terms.
